DPDP at LokSabha: The CyberPeace Outlook

The concept of web accessibility (i.e., access to the internet) stems from the recognition of internet access as an inalienable right. In 2016, the United Nations Human Rights Commission (UNHRC) General Assembly referred to the access to Internet as an essential human right. The Supreme Court of India also declared such internet access as a fundamental right under the Constitution of India. Various international instruments of which India is a signatory, such as the United Nations Convention on Rights of Persons with Disabilities (UNCRPD) mandate access to information. The heavy reliance on the internet and websites necessitates making the web space inclusive, navigational and accessible to all individuals, including persons with disabilities.

Various laws mandate web accessibility:

• Right of Persons with Disability Act, 2016: The Right of Persons with Disability Act 2016 Is the primary document for the protection of the rights of persons with disabilities to ensure their full participation. The Act provides several direct and indirect provisions (such as Section 2(y) “Reasonable Accommodation”, Section 40 on “Accessibility”, and Section 42 on “Access to Information and Communication Technology”) to ensure that technology products and services are accessible to a person with disabilities. 
• Rights of Persons with Disabilities Rules 2017: The 2017 rules under Rule 15 (2) task the respective Ministries and Departments to ensure compliance with accessibility standards.
• Guidelines for Indian Government Websites (GIGW): The GIGW provide a framework for websites to be designed in accordance with Web Content Accessibility Guidelines (WCAG) 2.0 standards. The GIGW enables websites to obtain certification by the Standardisation Testing and Quality Certification Directorate, after audit. 

Various other policies include;

• National Policy on Universal Electronic Accessibility, 2013: The National Policy ("Policy") on Electronic Accessibility recognizes the need to eliminate discrimination on the basis of disabilities and to facilitate equal access to Electronics & ICTs. The National Policy also recognizes the diversity of differently-abled persons and provides for their specific needs. The Policy covers accessibility requirements in the area of Electronics & ICT by different stakeholders. It recognizes the need to ensure that accessibility standards, guidelines and universal design concepts are adopted and adhered to.
• Web Content Accessibility Guidelines (WCAG): The WCAG defines how to make web content more accessible to persons with disabilities. While adhering to these guidelines is optional, various versions of the WCAG have been issued. It operates on four principles; perceivable, operable, understandable and robust. It provides a path to ensuring compliance and demonstrating reasonable accommodation for persons with disabilities.

However, despite the laws, web accessibility remains a challenge. A vast majority of Indian websites, especially e-commerce entities and several government websites remain inaccessible to persons with disabilities and most often do not conform with international accessibility standards. A report by the Centre of Internet and Society states that out of the 7800 websites of the Government of India, 5815 had accessibility barriers and 1985 websites failed to open. The report also notes that more than half of the websites had no navigation markup and only 52 websites had the option to change colours. The Ministry of Electronics and Information Technology (MeITy), during the 258^th Session of the Rajya Sabha on 9 December 2022 noted that 95 websites of the Central Government have been made accessible to persons with disabilities during the COVID-19 pandemic, however, only 45 websites of the Central Government have been certified as compliant under the Guidelines for Indian Government Websites (GIGW). As of that date, certification of the remaining governmental websites remains incomplete due to the pandemic. Meity also stated that the Department of Empowerment of Persons with Disabilities in 2017 sanctioned a project to be implemented by ERNET India for making 917 websites of State and Union territories. Under the project, a total of 647 websites have been made accessible as of that date.

Conclusion 

While India has established a robust legal framework and policies emphasizing the importance of web accessibility as a fundamental right, the existing gap between legislation and effective implementation poses a significant challenge. The reported accessibility barriers on numerous government and e-commerce websites indicate a pressing need for heightened efforts in enforcing and enhancing accessibility standards. 

In addressing these challenges, continued collaboration between government agencies, private entities and advocacy groups can play a crucial role. Ongoing monitoring, regular audits and public awareness campaigns may contribute to improving accessibility for persons with disabilities to ensure an inclusive environment and compliance with fundamental laws.

The World Wide Web was created as a portal for communication, to connect people from far away, and while it started with electronic mail, mail moved to instant messaging, which let people have conversations and interact with each other from afar in real-time. But now, the new paradigm is the Internet of Things and how machines can communicate with one another. Now one can use a wearable gadget that can unlock the front door upon arrival at home and can message the air conditioner so that it switches on. This is IoT.

WHAT EXACTLY IS IoT?

The term ‘Internet of Things’ was coined in 1999 by Kevin Ashton, a computer scientist who put Radio Frequency Identification (RFID) chips on products in order to track them in the supply chain, while he worked at Proctor & Gamble (P&G). And after the launch of the iPhone in 2007, there were already more connected devices than people on the planet.

Fast forward to today and we live in a more connected world than ever. So much so that even our handheld devices and household appliances can now connect and communicate through a vast network that has been built so that data can be transferred and received between devices. There are currently more IoT devices than users in the world and according to the WEF’s report on State of the Connected World, by 2025 there will be more than 40 billion such devices that will record data so it can be analyzed.

IoT finds use in many parts of our lives. It has helped businesses streamline their operations, reduce costs, and improve productivity. IoT also helped during the Covid-19 pandemic, with devices that could help with contact tracing and wearables that could be used for health monitoring. All of these devices are able to gather, store and share data so that it can be analyzed. The information is gathered according to rules set by the people who build these systems.

APPLICATION OF IoT

IoT is used by both consumers and the industry.

Some of the widely used examples of CIoT (Consumer IoT) are wearables like health and fitness trackers, smart rings with near-field communication (NFC), and smartwatches. Smartwatches gather a lot of personal data. Smart clothing, with sensors on it, can monitor the wearer’s vital signs. There are even smart jewelry, which can monitor sleeping patterns and also stress levels.

With the advent of virtual and augmented reality, the gaming industry can now make the experience even more immersive and engrossing. Smart glasses and headsets are used, along with armbands fitted with sensors that can detect the movement of arms and replicate the movement in the game.

At home, there are smart TVs, security cameras, smart bulbs, home control devices, and other IoT-enabled ‘smart’ appliances like coffee makers, that can be turned on through an app, or at a particular time in the morning so that it acts as an alarm. There are also voice-command assistants like Alexa and Siri, and these work with software written by manufacturers that can understand simple instructions.

Industrial IoT (IIoT) mainly uses connected machines for the purposes of synchronization, efficiency, and cost-cutting. For example, smart factories gather and analyze data as the work is being done. Sensors are also used in agriculture to check soil moisture levels, and these then automatically run the irrigation system without the need for human intervention.

• The IoT device market is poised to reach $1.4 trillion by 2027, according to Fortune Business Insight.
• The number of cellular IoT connections is expected to reach 3.5 billion by 2023. (Forbes)
• The amount of data generated by IoT devices is expected to reach 73.1 ZB (zettabytes) by 2025.
• 94% of retailers agree that the benefits of implementing IoT outweigh the risk.
• 55% of companies believe that 3^rd party IoT providers should have to comply with IoT security and privacy regulations.
• 53% of all users acknowledge that wearable devices will be vulnerable to data breaches, viruses,
• Companies could invest up to 15 trillion dollars in IoT by 2025 (Gigabit)

CONCERNS AND SOLUTIONS

• Two of the biggest concerns with IoT devices are the privacy of users and the devices being secure in order to prevent attacks by bad actors. This makes knowledge of how these things work absolutely imperative.
• It is worth noting that these devices all work with a central hub, like a smartphone. This means that it pairs with the smartphone through an app and acts as a gateway, which could compromise the smartphone as well if a hacker were to target that IoT device.
• With technology like smart television sets that have cameras and microphones, the major concern is that hackers could hack and take over the functioning of the television as these are not adequately secured by the manufacturer.
• A hacker could control the camera and cyberstalk the victim, and therefore it is very important to become familiar with the features of a device and ensure that it is well protected from any unauthorized usage. Even simple things, like keeping the camera covered when it is not being used.
• There is also the concern that since IoT devices gather and share data without human intervention, they could be transmitting data that the user does not want to share. This is true of health trackers. Users who wear heart and blood pressure monitors have their data sent to the insurance company, who may then decide to raise the premium on their life insurance based on the data they get.
• IoT devices often keep functioning as normal even if they have been compromised. Most devices do not log an attack or alert the user, and changes like higher power or bandwidth usage go unnoticed after the attack. It is therefore very important to make sure the device is properly protected.
• It is also important to keep the software of the device updated as vulnerabilities are found in the code and fixes are provided by the manufacturer. Some IoT devices, however, lack the capability to be patched and are therefore permanently ‘at risk’.

CONCLUSION

Humanity inhabits this world that is made up of all these nodes that talk to each other and get things done. Users can harmonize their devices so that everything runs like a tandem bike – completely in sync with all other parts. But while we make use of all the benefits, it is also very important that one understands what they are using, how it is functioning, and how one can tackle issues should they come up. This is also important to understand because once people get used to IoT, it will be that much more difficult to give up the comfort and ease that these systems provide, and therefore it would make more sense to be prepared for any eventuality. A lot of times, good and sensible usage alone can keep devices safe and services intact. But users should be aware of any issues because forewarned is forearmed.

Introduction

On 20th March 2024, the Indian government notified the Fact Check Unit (FCU) under the Press Information Bureau (PIB) of the Ministry of Information and Broadcasting as the Fact Check Unit (FCU) of the Central Government. This PIB FCU is notified under the provisions of Rule 3(1)(b)(v) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules 2023 (IT Amendment Rules 2023).

However, the next day, on 21st March 2024, the Supreme Court stayed the Centre's decision. The IT Amendment Rules of 2023 provide that the Ministry of Electronics and Information Technology (MeitY) can notify a fact-checking body to identify and tag what it considers fake news with respect to any activity of the Centre. The stay will be in effect till the Bombay High Court finally decides the challenges to the IT Rules amendment 2023.

The official notification dated 20th March 2024 read as follows:

“In exercise of the powers conferred by sub-clause (v) of clause (b) of sub-rule (1) of rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Central Government hereby notifies the Fact Check Unit under the Press Information Bureau of the Ministry of Information and Broadcasting as the fact check unit of the Central Government for the purposes of the said sub-clause, in respect of any business of the Central Government.”

Impact of the notification

The impact of notifying PIB’s FCU under Rule 3(1)(b)(v)will empower the PIB’s FCU to issue direct takedown directions to the concerned Intermediary. Any information posted on social media in relation to the business of the central government that has been flagged as fake or false by the FCU has to be taken down by the concerned intermediary. If it fails to do so, it will lose the 'safe harbour' immunity against legal proceedings arising out of such information posted offered under Section 79 of IT Act, 2000.

Safe harbour provision u/s 79 of IT Act, 2000

Section 79 of the IT Act, 2000 serves as a safe harbour provision for intermediaries. The provision states that "an intermediary shall not be liable for any third-party information, data, or communication link made available or hosted by him". However, it is notable that this legal immunity cannot be granted if the intermediary "fails to expeditiously" take down a post or remove a particular content after the government or its agencies flag that the information is being used unlawfully. Furthermore, intermediaries are obliged to observe due diligence on their platforms.

Rule 3 (1)(b)(v) Under IT Amendment Rules 2023

Rule 3(1)(b)(v) of The Information Technology(Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 [updated as on 6.4.2023] provides that all intermediaries [Including a social media intermediary, a significant social media intermediary and an online gaming intermediary], are required to make "reasonable efforts” or perform due diligence to ensure that their users do not "host, display, upload, modify, publish, transmit, store, update or share” any information that “deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature or, in respect of any business of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as the Ministry may, by notification published in the Official Gazette, specify”.

PIB - FCU

The PIB - Fact Check Unit(FCU) was established in November 2019 to prevent the spread of fake news and misinformation about the Indian government. It also provides an accessible platform for people to report suspicious or questionable information related to the Indian government. This FCU is responsible for countering misinformation on government policies, initiatives, and schemes. The FCU is tasked with addressing misinformation about government policies, initiatives, and schemes, either directly (Suo moto) or through complaints received. On 20th March 2024,via a gazetted notification, the Centre notified the Press Information Bureau's fact-check unit (FCU) as the nodal agency to flag fake news or misinformation related to the central government. However, The Supreme Court stayed the Centre's notification of the Fact-Check Unit under IT Amendment Rules 2023.

Concerns with IT Amendment Rules 2023

The Ministry of Electronics and Information Technology(MeitY) amended the IT Rules of 2021. The ‘Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2023’ (IT Amendment Rules 2023) were notified by the Ministry of Electronics and Information Technology on 6 April 2023. The rules introduced new provisions to establish a fact-checking unit with respect to “any business of the central government” and also made other provisions pertaining to online gaming.

The Constitutional validity of  IT Amendment Rules 2023 has been challenged through a writ petition challenging the IT Rules 2023 in the Bombay High Court. The contention is that the rules raise "serious constitutional questions," and Rule 3(1)(b)(v), as amended in 2023, impacts the fundamental right to freedom of speech and expression would fall for analysis by the High Court.

Supreme Court Stays Setting up of FCU

A bench comprising Chief Justice DY Chandra Hud, Justices JB Pardiwala and Manoj Misra convened to hear Special Leave Petitions filed by Kunal Kamra, the Editors Guild of India and the Association of Indian Magazines challenging the refusal of the Bombay High Court to stay the implementation of the IT Rules 2023. The Supreme Court has stayed the Union's notification of the Fact-Check Unit under the IT Amendment Rules 2023, pending the Bombay High Court's decision on the challenges to the IT Rules Amendment 2023.

Emphasizing Freedom of Speech in the Democratic Environment

The advent of advanced technology has also brought with it a new generation of threats and concerns: the misuse of said technology in the form of deepfakes and misinformation is one of the most pressing concerns plaguing society today. This realization has informed the critical need for stringent regulatory measures. The government is rightly prioritizing the need to immediately address digital threats, but there must be a balance between our digital security policies and the need to respect free speech and critical thinking. The culture of open dialogue is the bedrock of democracy. The ultimate truth is shaped through free trade in ideas within a competitive marketplace of ideas. The constitutional scheme of democracy places great importance on the fundamental value of liberty of thought and expression, which has also been emphasized by the Supreme Court in its various judgements.

The IT Rules, 2023,provide for creating a "fact check unit" to identify fake or false or misleading information “in relation to any business of the central government "This move raised concerns within the media fraternity, who argued that the determination of fake news cannot be placed solely in the hands of the government. It is also worth noting that if users post something illegal, they can still be punished under laws that already exist in the country.

We must take into account that freedom of speech under Article 19 of the Constitution is not an absolute right. Article 19(2) imposes restrictions on the Right to Freedom of Speech and expression. Hence, there has to be a balance between regulatory measures and citizens' fundamental rights.

Nowadays, the term ‘fake news’ is used very loosely. Additionally, there is a dearth of clearly established legal parameters that define what amounts to fake or misleading information. Clear definitions of the terms should be established to facilitate certainty as to what content is ‘fake news’ and what content is not. Any such restriction on speech must align with the exceptions outlined in Article19(2) of the Constitution.

Conclusion

Through a government notification, PIB - FCU was intended to act as a government-run fact-checking body to verify any information about the Central Government. However, the apex court of India stayed the Centre's notification. Now, the matter is sub judice, and we hope for the judicial analysis of the validity of IT Amendment Rules 2023.

Notably, the government is implementing measures to combat misinformation in the digital world, but it is imperative that we strive for a balance between regulatory checks and individual rights. As misinformation spreads across all sectors, a centralised approach is needed in order to tackle it effectively. Regulatory reforms must take into account the crucial roleplayed by social media in today’s business market: a huge amount of trade and commerce takes place online or is informed by digital content, which means that the government must introduce policies and mechanisms that continue to support economic activity. Collaborative efforts between the government and its agencies, technological companies, and advocacy groups are needed to deal with the issue better at a higher level.
